Temporary custody means when a couple is getting divorced, one of the parent files for this type of custody. It actually is very sensible to do this because a divorce case is not settled in a day. It takes a lot of time for divorce case to get settled and the time frame can be from 60 days to 1 year. It is a huge time gap and in the mean time the child can have a harrowing time between the parents if the custody does not exist. |
By having a temporary custody, the child will be staying with one parent, but at least it is clear that the child is in a stable environment. Mostly during the temporary custody the custodial parent is allowed to stay in the marital house, and also spousal support is authorized. Until the divorce case gets settled, the children and the custodial parent can live an unaltered lifestyle. The other parent is required to move out.
A temporary custody should only be considered as a temporary arrangement until a final conclusive decision on the custody is made by the court. There are several things that have to be decided in a divorce case. Some of them are assets, house, and finances and most important is child custody. Under child custody, what type of child custody is granted and the parenting plan has to be discussed. This could take a long time as the couple will need to agree on several things in relation to the children. Temporary custody also helps the couple to grow up in a different situation, and enables them to make mature decisions.
