Factors In Granting Temporary Custody

Temporary custody is a court released order where a parent or grandparent is given custody of the children. Such an arrangement is required when the custodial parent is unavailable, or cannot be there for the child. For example, if the child is traveling out of the country or some other place where the custodial parent will not be present, then a temporary custody form is required.

The time period of this kind of custody is mentioned in the form, and also the relationship with the guardian of the child is specified. The guardian can lawfully take care of the child and manage everything for the child.

However, if you are obtaining this type of permission on a temporary basis, then you should provide evidence supporting the reason. For example, if you are traveling with the child then the evidence should be submitted in the form of tickets. Also, the itinerary should be clearly sketched out. This form is important because in case the custodial parent is not reachable under some circumstances, then this form gives you the right to make the decisions on behalf of the custodial parent for the benefit of the child. Some examples are medical emergencies and last minute travel changes due to unavoidable or unforeseen circumstances.

Such custody is granted only through the agreement of the custodial parent. In order to get the permission from the court, you should be the biological parent of the child. In such case, the court is in a position to over rule the non-custodial parent's objections.
