Information On Physical Custody

Physical custody is term that refers to where the child will live on a daily basis once the parents divorce. If the child lives with just parent, then it is known as sole physical custody. This means that only parent has the legal right to take care of day-to-day needs of the child, and thus, the child lives with that parent. The other parent is referred to as the non-custodial parent, and will usually have the right to visit the child.

However, if the parents divorce on amicable terms, or are equally worried about the wellbeing of the child, then they can agree to something known as joint physical custody. This only works if the two divorced parents live close to each other. In type of physical custody, the child spends half his time with parent and the other half with other parent. The parent who spends more time with the child is known as to be given the primary physical custody of the child.

In joint physical custody, both parents equal or near equal time with the child. Here the child has contact with both the parents, and spends time living with both parents alternatively. This is considered to be the best arrangement from the psychology of a child.

In sole physical custody, the lives with just one parent, while the other parent is only granted visitation rights by the court.

Physical custody is a term that you should be aware of if you are getting a divorce. This way, with the help of your lawyer, you can take all the necessary steps to ensure that you get your parental rights, keep maintaining the relationship with your children, and also ensure that you carry out all your parental responsibilities.
