Primary physical custody means that the parent has the sole right of the child to live with him or her. The other parent may have visitation rights or just plain legal custody, but the children may not stay with that parent. It is possible to have primary physical custody or joint physical custody. |
However, in the former the children end up staying with only one parent, while the other parent still takes care of the expenses for the children. The visitation rights may be given accordingly where the child will be spending the weekends or holidays with the other parenting. The other parent will be taking acre of expenses in equal share.
In joint legal custody, both the parents have equal rights over the responsibilities like education, health and the child’s overall upbringing. Having legal custody means giving power to both the parents to make decisions about the children. This has no bearing upon with whom the child will be staying. You need to have a legal parenting plan in order to decide where the children will be spending their time, and with whom. In joint legal custody, either parent can have the child or in most cases, it is half and half. If it is not possible to have the child with you for half the time, then alternatives can be worked out in the parenting plan where the children will spend holidays with one parent and school days with other parent.
Compared to primary physical custody, joint legal custody is the most common kind of arrangement that happens between divorcing couples.
