What Does Legal Custody Mean ?

Child custody is very easy to think about, but when it comes to talking about it in the court, it is the most confusing thing. Couples are often misled by their own understanding of legal terms. When it comes to law, the most common English word can have the most complicated meaning. In order to understand what child custody means, you need to get acclimatized to the legal terms.

People think that once they have custody, they are the owners of their children. Well it is not that simple. There are several types of custody that a person can have.

Having the legal custody of your child it means that you have the right for all legal responsibilities. Most parents get joint legal custody unless there is a reason for denying this type of custody. This means that both the parents have equal right to their children and can make decisions with equal power. For example, they both can decide about the education, health, schooling and several other things. So, both the parents are the legal guardians of the child who can make all the necessary decisions for the wellbeing of the child. If one parent has the full legal custody of the child, then only that parent will make these decisions and the other parent will have no say whatsoever.

Another aspect of child custody is physical custody. If a parent has the complete physical custody of the child, then only that parent can have the child in their house. However, the other parent can still have legal custody where they can make decisions about the child’s future. Full child physical custody or just custody is quite rare.
