How To Make A Parent Take Custody Of Their Child ?

When parents divorce, they often come to a decision regarding custody of the child or children between themselves, perhaps with the aid and intervention of their attorneys. When such an arrangement is not possible, the issue is decided by the court. In making its custody decision, the court will keep the best interests of the child at heart.

The following points will be of paramount consideration:

• The child’s wishes, if old enough to express a reasonable preference;
• Both parents’ mental and physical health;
• Religion and/or cultural circumstances;
• Continuity of secure home environment;
• The capacity to interact with members of either parent’s extended family;
• Communication and interrelationship with other members who live in the same household;
• Adaptability to school and community;
• Age and sex of child;
• Excessive parental discipline or emotional abuse; and
• Proof of drug, alcohol or sex abuse by either parent.

There are five types of custody awards:

• Legal custody is often awarded to both parents, where they jointly make decisions relating to their child’s life and well-being.
• Physical custody which determines with which parent the child will live. This is often awarded jointly if both parents live in proximity to one another and if so doing does not upset the stable life of the child.
• Sole custody awarded to any one parent on the basis that the other is not competent to raise the child.
• Joint custody is where the parents live separately but both share the custody of the child. However, there are few restrictions imposed.
• Bird’s nest custody is a strange child custody arrangement. Here the parents live in the same house but lead different lives and have nothing to do with each other. However, when it is the turn of parent to see the child, the other parent moves out.
