Single Fathers And Parental Rights

In the absence of a Parental Responsibility Agreement or Order, a single father has abysmally few legal rights relating to his child, though he is within his rights to approach the court with an application for contact.

A single father also has a bounden responsibility to his child, which means an obligation to ensure it is looked after and supported financially, emotionally and physically.

If at the time of birth an unmarried father registers the birth of his child, he automatically gains paternal responsibility. However, if no such precaution is taken, he forfeits his rights over the child automatically, and can intervene only in event of an emergency. Without legal rights, a single father has no say in selection of a name for the child, in deciding which religion the child will practice, where and how the child is to be educated, what sort of medical treatment the child is to receive or even if the child is to be surrendered for adoption. The single father has no legal standing to access the child’s official documents or medical records, and is not authorized to submit an application for a passport for a child.

However, it is incumbent on the single father to pay for child support on demand.

If he is denied a Parental Responsibility Agreement by the mother, the single father is entitled to apply for a Parental Responsibility Order. This will be awarded by the court if it is satisfied with the bona fides of the application and that the father is a fit and proper person to meet his obligations.

The decision of any court will be determined keeping the welfare of the child paramount.
